My License

In Massachusetts, if you refused the breath or blood test your license will be suspended for 180 for a first offense, Three (3) years for a second offense, Five (5) years for a third offense and a LIFETIME suspension for a fourth offense.

Win Your Case

Drunk Driving (OUI, DUI, DWI) Defense is a specialized area of the law. You need to speak to a lawyer who concentrates in fighting your OUI case. You should ask any lawyer you speak to how many Drunk Driving trials he or she has had in the past year. Mr. Milligan handles approximately 50-60 trials a year. Approximately 70-80% of his cases are resolved by way of Acquittal/Not Guilty or Dismissal.

Don't Plead Guilty

Effective November 28, 2002, Massachusetts changed its laws concerning drunk driving cases (OUI, DUI, DWI). Instead of a 10-year look back period for multiple offenses, drunk driving cases will now affect you for the REST OF YOUR LIFE.

First Day in Court

Contact an experienced Massachusetts Drunk Driving Attorney as soon as possible and prior to your Drunk Driving (OUI, DUI, DWI) arraignment, if possible.

OUI Law

This summary covers the judicial penalties for the criminal offense of operating a motor vehicle under the influence of alcohol (OUI.) Many other non-judicial penalties will inevitably follow an admission to sufficient facts plea, guilty plea, or conviction. These can include increased insurance cost (or cancellation of coverage), inability to rent cars, job barriers, possible loss of certifications, etc. These non-judicial or economic penalties are not addressed in this Summary.

FAQs

Q. When will I lose my License as a result of refusing to submit to the Breath Test or as a result of failing the Breath Test (A reading of .08 or above)?

A. The police department should have confiscated your Massachusetts Driver's License and issued you a piece of paper which will serve as your 15 day temporary license unless you are licensed out of Massachusetts. The 15 day period will run 12 hours from the time of your arrest. For instance, if you were arrested at midnight, you temporary will be valid and start to run at noon the next day.

Common Terms

Arraignment- This is first day in court. You will be formally charged with the crimes against you and the court will enter a plea of not guilty for you or you will have to enter a plea of not guilty. The Court will then give you a date to come back for a pre-trial conference or pre-trial hearing;
